On condition that the requirements of the law are reserved and in accordance with the requirements of Act No.634 (Act of Independent Ownership),which states that for building(s) with more than 8 (eight) independent units, the owners are required to organize and vote for a Management Committee. The Management Committee will include a Manager, Site Supervisor, Secretary and other Officers the Site Committee sees fit to appoint. (As written in management plan)
STEPS IN ORGANIZING THE INITIAL MEETING
The Invitation Letter
1. Wth our assistance and support owners will prepare a letter inviting all owners to the first Meeting.
2. This letter must be sent to all owners by Registered Post.(Fax and email is not accepted by Turkish Law).
The Post Office registration slips of those letters must be produced at the First Meeting, as evidence that all owners have been notified of the First Meeting. The First Meeting is not legal if all owners are not notified.
3. The invitations to the First Meeting must be sent to all the owners a minimum of 14 days before the First Meeting.
4. When issuing the Invitation Letter to the First Meeting the location, time and date of a Second Meeting will be included, in the event of being unable to secure a sufficient number of participants for the First Meeting. The second Meeting is convened within one week at the latest of the First Meeting and regardless of whether a sufficient number of independent owners attend, decisions are made by the majority vote of those present at the meeting. The rights stipulated in the Act of Independent Ownership concerning a sufficient number are reserved.
5. A sufficient number of participants is usually 2/3 of the owners. Please note that number of participants is not necesassary for the second meeting. (As written in Management Plan)
6. Under Turkish law Owners who can not attend a Meeting can vote by proxy, that is, another owner or a person can vote on your behalf. In order to hold the majority, 2/3 owners must be present in the first meeting. Majority is not important for the second meeting.
